Building Permit Procedure and Application
I. TO OBTAIN A BUILDING PERMIT, YOU MUST HAVE:

1.  Building Permit Application

II. HOW DO I GET MY PERMIT PROCESSED?

1. Fill out all the information on Page 1 of the application.
2. Sign the application on Page 2.
3. Circulate the application for review/approval to the Inspectors and/or Boards listed on Page 2 of the application. It is the responsibility of the applicant to circulate and obtain signatures.
4. Signatures do not necessary have to be obtained in the order listed on the application, however, the Board of Selectmen will not sign an application until everyone listed above them has signed off and the Building Inspector will not sign until the Selectmen have signed.
5. If you are unsure which or if all reviews/approvals are required for your particular project, contact the Board of Selectmen at 232-0319 or the Building Inspector at 232-0313.

When all signatures/approvals have been obtained, applicants may meet with the Building Inspector each Monday evening beginning at 7:00 PM in his office on the 2nd floor of the Town Hall, 9 Main Street for final review, fee processing and approvals.
 
 

III. AFTER BUILDING PERMIT IS ISSUED, YOU MUST:

1. Call for an inspection of foundation footings prior to constructing walls and backfilling and at various stages during construction as per Building Inspector.

2. Obtain a permit from the Plumbing Inspector.

3. Obtain a permit from the Wiring Inspector.
Contact: Karl Cooper    232-0244

4. Inspection of building by Plumbing and Wiring Inspectors after plumbing and wiring has been roughed in and before studding is covered.

5. Final check on work by Wiring Inspector and Plumbing Inspector when building is substantially completed.  Building Inspector must also inspect building and sign a Certificate of Occupancy before building can be occupied.

Submit a Plot Plan for all types of new construction (outside of existing footprints) showing the location of the structure, giving dimensions, lot size, distances of frontage setback from the road right of way, distances to side and rear property lines, and driveway location.  Locate all existing buildings and give accurate distances between buildings and distances from property lines.
Submit five (5) copies of application, five (5) copies of plot plan and one (1) copy of construction plans and specifications, if applicable.  Submit a check for the fee (Payable to the Town of West Stockbridge) of twenty-five dollars ($25.) plus twenty cents ($.20) per sq. ft. of structure area (incl. all porches and decks). {A discounted  fee of $25. plus $.05 per square foot applies to those who can demonstrate that the permit is for low and moderate income housing or that the applicant is a non-profit developing affordable rental housing}.  Send/deliver check with completed application to the Building Inspector, Town of West Stockbridge, 9 Main Street, West Stockbridge, MA 01266.

Plot Plan and Construction Drawings:

 All applications must be accompanied by a plot plan and construction drawings.  All plot plans must show the proposed use, exact location of structure(s) on lot, distance of structure(s) from all lot lines, lot size, frontage, location of septic field and well (if any), streams, ponds, and other wetland areas.  Accessory buildings must be clearly marked and identified as to dimensions, location and building material.

State and Local Laws and By-laws:

 The Town of West Stockbridge strictly enforces the provisions of the Massachusetts State Building Codes, the Zoning By-laws, and other laws and regulations relative to the protection of public health and safety.  The applicant is responsible for adherence to all of the above and failure to adhere to these measures may result in the revocation of the building permit.

Massachusetts Wetlands Protection Act:

 Any proposed alteration of land within 100 feet of most wetland or flood prone areas requires the submission of a Request for Determination of Applicability to the Conservation Commission.  The Commission, at a public meeting, will determine whether or not the proposed activity will impact the wetland.  If the Commission determines that the activity will not impact a wetland, the applicant may proceed under the terms of the building permit.  If the Commission determines that the proposed activity will impact a wetland, the applicant shall be required to file a Notice of Intent and receive and Order of Conditions from the Commission.  Any submissions to the Conservation Commission must be filed prior to the commencement of work.
